Terms of Use
In short
- Upisode is free and helps you keep track of the shows and movies you watch. It is funded by ads, which you can remove with a one-time payment.
- Show data comes from TVmaze, and movie data from Wikidata and Wikipedia: we try to keep it accurate, but we can’t guarantee it.
- Use the app in good faith. You can leave at any time by deleting your account.
What these terms cover and how you accept them
These terms govern your use of Upisode, on the web, Android and iOS, provided by GitThreeLab. By creating an account, or by signing in with Google or Apple for the first time, you accept them together with the Privacy Policy. If you don’t agree, don’t use Upisode.
The service
Upisode lets you search for shows and movies, follow them, mark what you watch and see when the next episode or a movie comes out, with optional alerts on your phone. It is free, and both the Android and iOS apps and the website show ads.
The ads are served by ad networks (Unity LevelPlay or Google AdMob in the apps, Adsterra on the website): we don’t pick each one and aren’t responsible for what they advertise or the websites they lead to.
Upisode doesn’t stream any audiovisual content, and has no relationship with the networks, studios or platforms behind the shows and movies. When we say which platform a show or movie is on, or take you there with “Watch on…”, it is for information only: what you watch there is governed by each platform’s terms.
Show data and images come from TVmaze. They may contain errors or change, especially air dates, and we are not responsible for their accuracy.
Movie data comes from Wikidata, synopses from Wikipedia and posters from Fanart.tv or Wikimedia Commons. Release dates for each country and platforms may be missing or inaccurate, and we are not responsible for them.
Which platforms each show and movie is on in your country, how to watch it and its prices come from Streaming Availability API. Some platforms may be missing, especially local ones, and prices, dates and links may be inaccurate or out of date; we are not responsible for them.
Uncut and Patron
In the Android and iOS apps you can buy Uncut or Patron. They are one-time payments, with no subscription or renewals: they remove ads forever, on all your devices, and give you a frame, a title and a badge for your profile. Patron includes everything in Uncut, and anyone who already has Uncut becomes a patron by paying the difference. What’s free today stays free for everyone.
They are charged by Google Play or the App Store, under their terms, and the store handles refunds and the right of withdrawal, under those terms and the law. If it refunds you, the purchase no longer applies: ads come back and its frame, title and badge go.
The purchase goes with your store account: “Restore purchases” brings it back on another phone or another Upisode account. Without an Upisode account, ads go away on that phone only; the frame, title and badge need an account.
“Forever” means for as long as Upisode exists. If we ever shut down, we’ll give notice in advance, as explained in “Availability and changes to the service”.
Your account
- You must be at least 14 years old.
- The details you give when you sign up must be true, and the account is personal.
- You are responsible for keeping your password safe, or your access to your Google or Apple account if you sign in with them, and for what is done with your account.
- If you see activity on your account that you don’t recognise, change your password, sign out of other sessions in Settings and write to us at upisode@gitthreelab.com.
Acceptable use
You may not:
- Use Upisode for anything illegal or that harms other people.
- Try to access other people’s accounts or parts of the system not meant for you, or get around its usage limits.
- Create accounts automatically, or extract data from the app in bulk or with software.
- Interfere with, overload or attack the service.
Community guidelines
If you use Upisode’s social features (handle, profile, following other accounts and reviews), you accept these guidelines. They have zero tolerance: anything that breaks them is hidden, and the account may lose its social features.
Not allowed:
- Insulting, harassing or threatening anyone, or hate based on origin, religion, sex, orientation, disability or any other condition.
- Spoiling episodes after the one you are reviewing: each review belongs to its episode.
- Spam, advertising, links or contact details, yours or anyone else’s.
- Pretending to be another person or a brand.
- Sexual, violent or illegal content.
Every review and every profile can be reported from its menu, and you can block anyone you like. We review every report within 24 hours. If we hide something of yours, we email you to say what and why, and you can appeal by replying to that email or writing to upisode@gitthreelab.com.
Intellectual property
The app, its design, its brand and its code belong to GitThreeLab.
Show data belongs to TVmaze and is used under its Creative Commons BY-SA licence. Wikidata data is published under CC0, and Wikipedia synopses under CC BY-SA: each movie page credits and links the article its synopsis comes from. Images, titles and trademarks of shows and movies belong to their owners.
Availability and changes to the service
We do our best to keep Upisode running, but there may be interruptions for maintenance, because of faults or for reasons beyond our control, such as TVmaze, Wikidata, Wikipedia or Streaming Availability API becoming unavailable. We may change, add or remove features. If we decide to shut Upisode down, we’ll give reasonable notice so you can delete your account.
Liability
Upisode is provided as is. To the extent the law allows, GitThreeLab is not liable for damages arising from using it or being unable to use it, for errors in show or movie data, or for alerts that don’t arrive or arrive late. Nothing here limits your statutory rights as a consumer.
Leaving and suspension
You can stop using Upisode whenever you like and delete your account in Settings → Delete account, or by writing to upisode@gitthreelab.com.
We may suspend or delete an account that breaches these terms. Except in serious cases, we’ll warn you first and give you the chance to explain.
Changes to these terms
If we change them, we’ll publish the new version here with its date. If the change is significant, we’ll tell you in the app before it applies. Continuing to use Upisode afterwards means you accept them; if you don’t agree, you can delete your account.
Governing law
These terms are governed by Spanish law. If you are a consumer, you keep the rights granted by the law of your country of residence and may go to its courts.
